General Terms and Conditions (GTC) - Car Trade24

1. Scope & contractual basis

These General Terms and Conditions (GTC) govern all contracts between Car Trade 24 GmbH, Ringstrasse 26, 5610 Wohlen (hereinafter “Car Trade24”), and the Customer. They apply to the purchase of new and used vehicles and to all related services.

By signing the purchase contract, the Customer confirms having received, read and accepted the GTC. The GTC are available at any time at www.cartrade24.ch.

2. Definitions

New vehicle:: Vehicles with a manufacturer’s warranty and without any prior use other than transport movements.
Pre-registered vehicle (TZ):: Vehicles registered once abroad; the manufacturer’s warranty starts from that date.
Used vehicle / pre-owned vehicle:: Vehicles with at least one previous keeper or prior use.
Not an accident vehicle:: The vehicle has no structural damage, no frame damage and no safety-relevant repairs.
Defect:: A deviation from the contractually agreed condition. Normal wear and tear does not constitute a defect.
VFAS BODY INDEX®:: Industry standard for the objective assessment of vehicle bodywork.

3. Vehicle description & equipment

Vehicle listings are non-binding and serve as general guidance only. The following are decisive for the content of the contract:

the on-site inspection of the vehicle,
the written handover report,
the equipment listed in the purchase contract.

Brochure information, technical data and WLTP values may differ depending on the country of import, production run or model year. For the objective assessment of the vehicle’s condition, Car Trade24 uses – where available – the VFAS BODY INDEX®.

4. Imported vehicles & country variants

Due to country-specific configurations, imported vehicles may differ from Swiss series models (equipment, software, model year, operating logic).

The Customer confirms having been informed of the origin, pre-registration, possible country variants and differing warranty conditions.

5. Warranty & statutory warranty

5.1 New vehicles

For new vehicles, only the manufacturer’s warranty applies. Car Trade24 is not the guarantor and assumes no obligation to enforce warranty claims against the manufacturer. The Customer is obliged to comply with and document all service and maintenance intervals in accordance with the manufacturer’s specifications. Violations may result in the loss of the manufacturer’s warranty.

5.2 Used vehicles / pre-owned vehicles

For used vehicles, a warranty insurance may optionally be taken out with SuisseFox or NSA Garantie. The terms and conditions of the respective warranty insurer apply. Maintenance and service obligations must be fulfilled without gaps; otherwise, warranty claims may lapse.

5.3 Exclusion of statutory warranty

The statutory warranty is excluded to the extent permitted by law. There is no entitlement to price reduction, rescission, replacement vehicles or damages. Clause 13 and fraudulently concealed defects remain reserved.

6. Condition, accident status & signs of use

Car Trade24 does not guarantee “accident-free”, but exclusively whether the vehicle is classified as “not an accident vehicle”. Signs of use and ageing (e.g. stone chips, scratches, seat wear) do not constitute a defect.

7. Trade-in vehicles

The Customer guarantees that the trade-in vehicle:

is owned by the Customer;
is free of third-party rights, leasing, liens or debt enforcement proceedings;
has no concealed damage or accidents;
has a correctly stated mileage.

If the information deviates significantly, Car Trade24 is entitled:

to adjust the trade-in price or
to withdraw from the contract.

The condition of the trade-in vehicle at the time of handover is decisive. The Customer is liable for damage caused by incorrect information.

8. Purchase price & means of payment

The following payment methods are accepted:

bank transfer,
TWINT (up to CHF 1'000.–),
leasing/financing.

Cash payments are only possible in exceptional cases by prior arrangement. The purchase price is due for payment no later than one working day before the agreed handover; any deposit is stated in the purchase contract. Vehicles are delivered only after receipt of payment in full.

9. Delivery date & delay in delivery

Delivery dates are non-binding. In the event of a delay in delivery, the Customer is granted a grace period of 30 days. If the vehicle cannot be delivered within this period for reasons for which Car Trade24 is not responsible, Car Trade24 is entitled to withdraw from the contract. After the grace period has expired without delivery, the Customer is also entitled to withdraw from the contract.

In both cases, payments already made are refunded in full. Further claims are excluded; Clause 13 remains reserved.

10. Withdrawal in the event of supplier or manufacturer changes

Should manufacturers or importers make significant changes after conclusion of the contract, the Customer will be informed thereof; the Customer may continue the contract under the amended conditions or withdraw. In this case, Car Trade24 is also entitled to withdraw from the contract. Payments are refunded in full. Claims for damages are excluded.

11. Withdrawal by the Customer

Withdrawal by the Customer is excluded in principle. If the Customer nevertheless withdraws without legal grounds, Car Trade24 may claim a lump-sum compensation of 15 % of the sale price (incl. VAT).

12. Delivery, Premium Service & registration

Basic delivery is included in the vehicle price; it does not include a full tank of fuel. The Premium Service may optionally be booked for a flat fee of CHF 490.–; it comprises a technical inspection, cleaning, preparation of the documents and a full tank of fuel. Not included are licence plates, motor vehicle tax and personalised registration numbers.

Registration is carried out by the Customer or by Car Trade24 as agreed in the purchase contract.

13. Limitation of liability

Car Trade24 is liable only for damage caused intentionally or through gross negligence. Liability for indirect damage, consequential damage, loss of use and loss of profit is excluded. Mandatory statutory liability provisions, in particular under the Product Liability Act (Produktehaftpflichtgesetz), remain reserved.

14. Data protection (DSG 2023)

Car Trade24 processes personal data in accordance with the Federal Act on Data Protection (DSG 2023). Processing takes place for the purposes of contract performance, communication, financing assessment, warranty and insurance handling and statutory archiving obligations. Data may be disclosed to warranty insurers, leasing partners, registration authorities, IT/CRM service providers and hosting providers.

The Customer has the right at any time to information, rectification or erasure (where permissible). Controller: Car Trade 24 GmbH, Ringstrasse 26, 5610 Wohlen.

15. Place of jurisdiction & applicable law

Swiss law applies. The place of jurisdiction is Bremgarten (AG), unless the law provides for a mandatory place of jurisdiction. Should individual provisions of these GTC be invalid, the remainder of the contract shall remain valid.

16. Leasing & financing

If payment is made via leasing or financing, the purchase contract is subject to the condition that the financing company approves the application. If the application is rejected, the contract lapses without any compensation consequences; payments already made are refunded in full. The leasing or credit agreement is concluded separately between the Customer and the financing company; its terms and conditions apply.
